Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Canadian air operators conducting air taxi operations with propeller-driven aeroplanes that have a Maximum Certified Takeoff Weight (MCTOW) of 8618 kg (19,000 lbs) or less, and the pilots employed by those operators from the training time requirements detailed for aeroplanes that are certificated for twenty (20) or more passenger seats, as tabulated in Table I & II of subsection 723.98(27) of the Commercial Air Service Standards (CASS) – Air Taxi - Aeroplanes made pursuant to subsection 703.98(1) of the Canadian Aviation Regulations (CARs). This exemption is subject to the following condition.
The details of the above provisions are attached at Appendix A.
Purpose
The purpose of this exemption is to permit Canadian air operators conducting air taxi operations by propeller-driven aeroplanes that are certificated for twenty (20) or more passenger seats and with a MCTOW of 19,000 lbs or less under subpart 3 of Part VII of the CARs and their flight crewmembersto use those training times applying to Multi-engine 10* to 19*, as listed in Table I and Table II referred to in subsection 723.98(27) of the CASS. This will standardize the application of training times when addressing similar aeroplane types that have certain variants certificated for more than nineteen (19) passenger seats (excluding normal flight crewmember seats), which may be authorized to operate under subpart 703 of the CARs. An example of such could be a Twin Otter, DHC 6 – 300 Series configured for use to carry up to nine (9) passengers plus cargo.
Application
This exemption applies to Canadian air operators conducting air taxi operations by propeller-driven aeroplanes with an MCTOW of 19,000 lbs or less, and their flight crewmembers, undergoing initial (Table I) or recurrent (Table II) training on that specific type of aeroplane.
Condition
This exemption is subject to the Canadian air operators submitting to Transport Canada Civil Aviation revisions to their existing training programs resulting from this exemption and receiving the Minister’s approval of such changes, in accordance with subsection 703.98(1) of the CARs.
Validity
This exemption comes into effect on October 1, 2008 at 00:01 EDT and remains in effect until the earliest of the following:
- March 31, 2010 at 23:59 EDT;
- The date on which an amendment to the appropriate provisions of the Canadian Aviation Regulations and related standards comes into effect;
- The date on which the condition set out in this exemption is breached; or
- The date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.

703.98 (1) Every air operator shall establish and maintain a ground and flight training program that is
- designed to ensure that each person who receives training acquires the competence to perform the person's assigned duties; and
- approved by the Minister in accordance with the Commercial Air Service Standards.

- In Tables I and II,
- the term "flight training time" means "flight time";
- the terms "Level A", "Level B" and "Level C" refer to the approved training program, not to the certification level of the simulator used.
- Pilots will receive some PNF time in the simulator in addition to the PF times given in these tables.
